US Immigration Process:
To become an immigrant you must pass multiple steps process as is required. An Immigrant
also called "lawful permanent resident" is a foreign national who has been
granted the privilege of living and working permanently in the United States under certain
restriction.
A Green Card holder has the right to live and work permanently in the United States. Green
Card holders have to follow immigration law and be properly registered with the United
States government.
Green Card holders are entitled to depart from United States on holidays or for work
purposes.
However, there are certain restrictions on how long immigrants can stay outside the United
States without losing his or her Green Card. In many cases a document called a
"Reentry Permit" must be obtained from the USCIS regarding this issue.
The first step is to be eligible for US immigration under one of the paths to lawful
permanent residency.
The US immigration system is based primarily on family unification, needs on skilled
workers, employment creation, and recognition of refugees.
Also, there is a lottery for people who come from countries with low rates of immigration
to the United States.
You must determine if you are eligible under one of the paths to US immigration, also
including Family Immigration, Employment Immigration, Investment Immigration, Lottery,
Adoption Refugees & Asylum.
The USCIS must approve an Immigration Visa Petition for the applicant, which is usually
filed by a sponsor (employer, relative, etc). However certain individuals can petition on
the own behalf like priority workers, investors and others.
To apply for a lawful permanent resident based on employment, require a labor
certification request submitted by your US employer with the Labor's Employment and
Training Administration.
An immigrant visa number, through the State Department must be immediately available for
you, even if you are already in the United States
If you are in the United States, you may apply to adjust to permanent resident status
after a visa number becomes available for you. If you are outside the United States when
an immigrant visa number becomes available for you, you must then go to your local US
consulate to complete the process.
